Our total aggregate liability for all claims arising out of or related to the site is capped at the amount you paid to us, if any, in the 12 months preceding the event that gave rise to the claim, or 100 EUR (or CAD 100), whichever is lower. These Terms and your use of the site are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario, without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the courts located in Toronto, Ontario for any dispute that is not subject to the informal resolution process described below.
12. Dispute Resolution
Before filing a claim, you agree to contact us using the details in the Contact section to give us an opportunity to resolve the issue informally. If the dispute is not resolved within 30 days of your initial notice, either party may pursue relief in the courts identified in the Governing Law and Jurisdiction section. Nothing in these Terms prevents either party from seeking injunctive or other equitable relief to prevent or stop unauthorized use or abuse of the site or to protect intellectual property rights.
13. Termination and Suspension
We may suspend or terminate your access to the site, with or without notice, if we believe you have violated these Terms or used the site in a way that could cause harm. Upon termination, your right to use the site immediately ceases. Sections that by their nature should survive termination, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution, will continue to apply.
